The Supreme Court has directed a CBI probe into the death of a 25-year-old Manipuri woman, who was found dead under mysterious circumstances in a rented house in South Delhi in 2013, saying unsolved crimes erode people's faith in institutions established to maintain law and order. At Malviya Nagar police station, an FIR was registered under Indian Penal Code (IPC) section 306 (abetment of suicide) against unidentified accused persons. The investigation was transferred to the Malviya Nagar Crime Branch, and IPC section 302 (murder) was added to the case on the request of the deceased's relatives.

Later, two relatives of the deceased filed a petition in the Delhi High Court seeking directions to hand over the investigation to the Central Bureau of Investigation (CBI).

The High Court, while dismissing the petition, had said that it appears that the investigating agency has conducted the investigation without any bias and nothing has come to light that the landlord Rajkumar and his close relative Amit Sharma were in contact with any political leader to influence the investigation. Close relatives of the deceased, Avgunshi Chirmayo and Thotrethem Longpinao, challenged the high court order in the apex court, which constituted a Special Investigation Team (SIT) in 2019 to oversee the investigation.

The SIT came to the conclusion in its report that the woman had committed suicide by consuming medicine or poison. However, this was not confirmed in the 'Visra' report. The top court said that there is no reason for a girl to commit suicide at the age of 25.

The court said, “Prima facie it does not appear that this is a case of suicide.” At the crime scene, blood was spread on the surface and the bedsheet was stained with blood. It seems that this is a case of murder, so the culprits must be caught.

Justice J. Of. A bench of Justice Maheshwari and Justice Sudhanshu Dhulia set aside the Delhi High Court order which had rejected the petition requesting transfer of the investigation to the CBI.

The top court said, “It has been found that unsolved crimes reduce the faith of the people in the institutions which have been established to maintain law and order.” Investigation of crime should be fair and effective.

The Court said that it is of the view that there is a need to hand over the case to the CBI for proper investigation, and to remove any doubts in the minds of the appellants and to bring the real culprits to justice.

The top court said that the High Court's order dated May 18, 2018, in which the request of the present appellants to transfer the investigation to the CBI, was rejected.

The court said, “The appeal is accepted and we direct that the CBI investigate the matter.” The case should be transferred from SIT to CBI.'' The bench said that after thorough investigation, CBI should submit its complete investigation report or charge sheet in the concerned court as soon as possible.
