UP: 8 couples had reached the High Court after marrying in another religion, the court did not accept this demand – Allahabad HC dismisses petitions by eight interfaith couples seeking protection lclk theinsiderinsight


Allahabad High Court rejected the petition of 8 couples marrying in other religions citing the law of UP government. These couples who had inter-religious marriage had reached the court demanding security.

The court rejected the petitions of these eight interfaith couples saying that their marriages did not comply with the anti-conversion law of Uttar Pradesh. The Uttar Pradesh Prohibition of Unlawful Religious Conversion Act (passed in 2021) prohibits religious conversion by misrepresentation, force, fraud, undue influence, coercion and inducement.

These couples, through separate petitions, had sought an order from the High Court for their safety and non-interference in their marital life. The court rejected these petitions on different dates between 10 and 16 January.

Justice Saral Srivastava, while dismissing the petitions, said that these interfaith marriages were not in accordance with legal provisions as the anti-conversion law was not followed.

Of these eight cases, five were of Muslim men marrying Hindu women and three of Hindu men marrying Muslim women. The court has mentioned the religion of the petitioners in its order.

Rejecting the petitions, the court said, 'In view of the facts, the relief sought by the petitioners cannot be granted. Consequently, the writ petitions are dismissed.

However, the court has definitely given relief to the petitioners that if they have got married after following the proper legal procedure, then they can file a fresh writ petition.
