A PIL has been filed in the Delhi High Court seeking direction to stop Delhi Chief Minister Arvind Kejriwal from issuing orders while he is in the custody of the Enforcement Directorate (ED). Kejriwal was arrested on the night of March 21 in a money laundering case related to the alleged excise policy scam and the local court has sent him to ED custody for questioning till March 28.

Petitioner Surjit Singh Yadav has said in the PIL that issuing such orders by Kejriwal as Chief Minister is against the legal framework as well as the principle of fair and proper investigation.

The ED has accused Kejriwal of being directly involved in a conspiracy allegedly hatched during the formulation of the excise policy with the intention of benefiting certain people.

Yadav, who describes himself as a social activist, has claimed in the PIL that Kejriwal has “almost lost his position” and by being in custody, he has disabled himself from performing the duties and responsibilities of a public servant. Is.

The PIL said, “Respondent No. 4 (Kejriwal) is violating the oath of secrecy taken under the Third Schedule of the Constitution of India by issuing directions/orders while in the custody of Respondent No. 2 (ED).” Because any direction/order passed by him is scrutinized by defendant no. 2 because defendant no. 4 is in his custody.

It said, “Issue of instructions/orders by respondent No. 1 to 3 (Centre, ED and Delhi Government) to respondent No. 4 while in custody and communication of the said order to respondent No. 5 (Minister Atishi, Delhi Government).” “The inaction to prevent this is a blatant example of abuse of power and position, and deserves intervention by this Honorable Court.”

It has been requested in the petition that the court should direct the ED not to provide typewriter, computer and printer to the AAP leader. Last week, Yadav had filed another PIL seeking removal of Kejriwal from the post of chief minister following his arrest.
